The Clean Air Act (CAA) is a comprehensive federal law that regulates air emissions from stationary and mobile sources. The Act calls for states and EPA to solve multiple air pollution problems through programs based on the latest science and technology information. There are generally four different categories of air pollution sources, such as the following:
- Title V Source
- Significant Minor Source
- Synthetic Minor Source
- True Minor Source
Most of these source categories require an Air Construction or Operating Permit, and these permits typically require an annual and/or semi-annual Air Report.
Who is required to report?
Depending on regulations that the site is subject to, all sources can potentially be required to report. The following list shows the typical reports that need to be submitted by each source:
- Title V:
- Annual Title V Certification of Compliance
- Title V Operating Permit Semi-Annual Report (*Note – some Title V sites are required to report quarterly)
- Significant Minor:
- Reporting for a Significant Minor Source is determined by type of permit in place.
- Synthetic Minor:
- Annual Synthetic Minor Operating Permit Report (*Note – some Synthetic Minor sites are required to report semi-annually)
- True Minor:
- Reporting for a True Minor Source is determined by the facility’s applicable regulations.
When and where to submit Air Reports:
Air Reports are usually required to be submitted by January 31st and July 31st of each year depending on the site’s permit (but can vary by state) (see https://www.mdeq.ms.gov/land/waste-division/enhance/calendar/). The reports are required to be sent to the local permitting agency while some reports may also need to be submitted to EPA.
In some cases, based on the site’s applicable regulations, a submittal through EPA’s Compliance and Emissions Data Reporting Interface (CEDRI) may be required (see https://cdx.epa.gov/).
